NEW BOOK ON THE CUBAN 5  

A key chapter in a new book, What Lies Across the Water: the Real Story of the Cuban Five, is now available. The author of the book is Stephen Kimber, a professor of Journalism at the University of King's College in Canada. The chapter entitled "Shootdown" exposes the absurdity of the conspiracy to commit murder charge against Gerardo. People who have e-book can get the chapter by going to Amazon.com

NEW LEGAL STEP IN THE CASE OF THE CUBAN 5

On June 6, 2012, a motion requesting an Oral Argument and Discovery was filed with the U.S. Southern District Court of Florida (Miami Court) on behalf of Gerardo Hernández by counsel Tom Goldstein and Martin Garbus*, through his local counsel Richard Klugh.

This motion is part of the collateral appeal process initiated on June 14, 2010, and is based on the right Movant and his co-defendants have to know whether the Government was funding a negative publicity campaign about them during the trial whose purpose was to ensure their convictions.

Its purpose is to obtain, through interrogatories, document production,  depositions and subpoenas all the necessary evidence to be fully examined by the Court in an evidenciary hearing and prove, at that hearing, that the legal consequences of the evidence will be that the convictions must be set aside.

The discovery seeks to establish:

(1) the full scope of the issue by identifying all journalists and media organizations that received funds from the United States and then published false, hostile, inflammatory and prejudicial statements about Movant and his co-defendants, as well as the specific articles, interviews, and television and radio segments in which those statements appeared;

(2) the precise degree of the Government's influence and control over these journalists and media organizations;

(3) the degree of knowledge held not only by the U.S. State Department, which actually paid the journalists, but also by other branches of the Government, including the U.S. Department of Justice;

(4) the prejudicial impact of the Government's propaganda campaign on Movant's trial.

The discovery requests include 84 individuals connected to inflammatory press coverage relating to this case, 7 TV Stations and 13 Radio Stations.

* Martin Garbus is one of the country's leading trial lawyers. He has appeared before the United States Supreme Court as well as trial and appellate courts in the nation, in over 100 cases. Mr. Garbus's skill as a trial lawyer has earned his distinguished reputation as a result of his courtroom skills. He is an expert at every aspect of litigation and trial, from jury selection to cross-examination to summation. His cases have established new legal precedents in the Supreme Court and courts throughout the country.  Mr. Garbus, who taught trial practice at the Yale Law School and Constitutional law at Columbia is the author of six books and numerous articles, that have appeared in the New York Times, the Washington Post, the Los Angeles Times and in legal publications.  He was during a lot of years personal friend and colleague of Leonard Weinglass, through whom he came in contact with the case of the Cuban Five.

 UN NUEVO LIBRO SOBRE LOS 5 CUBANOS

Un capítulo clave de un nuevo libro "Lo que se encuentra a través del agua: La verdadera historia sobre los 5 Cubanos", está disponible. El autor del libro es  Stephen Kimber, Profesor de Periodismo de la Universidad Colegio del Rey de Canadá. NUEVA ACCIÓN LEGAL EN EL CASO DE LOS CINCO

El 6 de junio de 2012, los abogados Tom Goldstein y Martin Garbus*, abogados defensores de Gerardo Hernández Nordelo presentaron, a través de su abogado local Richard Klugh, ante la Corte del Distrito Sur de la Florida una moción solicitando una audiencia oral, así como que la Corte ordene al Gobierno entregar documentos y otros materiales que obran en su poder y que no han sido dados a conocer durante el proceso legal (procedimiento conocido como Discovery).

Esta moción es parte del proceso de apelación colateral iniciado el 14 de junio de 2010 y está basada en el derecho que tiene el Peticionante y sus co-acusados de conocer el alcance de la campaña de publicidad negativa contra ellos financiada por el Gobierno con la intención de asegurar que fueran declarados culpables.

Su propósito es obtener, mediante interrogatorios, presentación de documentos, deposiciones y citaciones judiciales, toda la evidencia necesaria para que sea  examinada por el tribunal en una audiencia evidenciaría y probar, en esa audiencia  que las condenas deben ser anuladas.

El procedimiento de Discovery busca establecer:

(1)  el alcance total del tema identificando a todos los periodistas y los medios de Prensa que recibieron pagos de Estados Unidos y después publicaron declaraciones falsas, hostiles, incendiarias y perjudiciales acerca del Peticionante y sus co-acusados, así como los artículos, entrevistas y segmentos de radio y televisión en donde aparecieron esas declaraciones;

(2) el grado preciso de influencia y control del Gobierno sobre esos periodistas y medios de prensa;

(3) el grado de conocimiento que tenían no solamente el Departamento de estado de Estados Unidos, que en realidad le pago a los periodistas, sino también otras de las ramas del Gobierno, incluyendo del Departamento de Justicia;

(4) el impacto prejudicial que la campaña de propaganda del Gobierno tuvo sobre el juicio del Peticionante;

La solicitud de Discovery incluye a 84 individuos vinculados a la cobertura prensa incendiaria relacionada con este caso, 7 estaciones de televisión y 13 estaciones de radio.

* MARTIN GARBUS, reconocido en Estados Unidos como uno de los más importantes abogados litigantes en casos nacionales e internacionales.  Su larga carrera profesional abarca la defensa de innumerables casos, incluso en la Corte Suprema, algunos de los cuales han sentado precedentes jurídicos en el sistema norteamericano y una activa labor mediática.  Es además profesor en prestigiosas Universidades de Estados Unidos y ha escrito varios libros sobre la temática jurídica. Garbus fue durante muchos años amigo personal y colega de Leonard Weinglass, por quien conoció el caso de los Cinco.
