U.S. Government Asks Florida Court to Reject Appeals of Ramon and Fernando / Solicita Gobierno de Estados Unidos a Corte de la Florida que rechace apelaciones de Ramón y Fernando

_ On December 6, 2011, the U.S. government asked the Court of the Southern District of Florida to dismiss the collateral appeals of Ramon Labañino and Fernando Gonzalez, arguing that both arguments lack legal merit to be considered by that Court.

In the response filed with the Court that day, the Government argued that the argument about the payment by the Government to local journalists in Miami, before and during the trial of the Five to create a climate of hostility against them and prejudice the jury-present in both appeals-"is not a violation of due process." They also objected to the remaining arguments and asked the judge to dismiss them.

The motion of the government responds to appeals filed by lawyers for the defense of Ramon Labanino and Fernando Gonzalez on August 8 and September 12, 2011 respectively. It is now for the defense to present its response to this motion, which should occur early next year and thus conclude the documentation process of appeals before the Court. Then it will be pending the decision to be adopted by the Judge, who does not have a specific period of time to do it. (Www.antiterroristas.cu)

Solicita Gobierno de Estados Unidos a Corte de la Florida que rechace apelaciones de Ramón y Fernando

El 6 de diciembre del 2011, el gobierno de Estados Unidos solicitó a la Corte del Distrito Sur de la Florida que rechace las apelaciones colaterales de Ramón Labañino y Fernando González, alegando que los argumentos esgrimidos por ambos carecen de méritos legales para ser considerados por dicha Corte.

En la respuesta presentada ante la Corte ese día, el Gobierno adujo que el argumento sobre el pago por parte del Gobierno a periodistas locales de Miami antes y durante el juicio contra los Cinco para crear un clima de hostilidad contra ellos y prejuiciar al Jurado —presente en ambas apelaciones—, "no constituye una violación del debido proceso". Igualmente objetaron los restantes argumentos y pidieron a la Jueza que los desestime.

La moción del Gobierno responde a las apelaciones presentadas por los abogados de la defensa de Ramón Labañino y Fernando González el 8 de agosto y 12 de septiembre del 2011 respectivamente. Corresponde ahora a la defensa presentar su réplica a esta moción, lo que deberá producirse a inicios del próximo año y con lo cual concluirá el proceso de documentación de las apelaciones ante la Corte. Quedará pendiente entonces la decisión a adoptar por la Jueza, quien no tiene un plazo específico de tiempo para hacerlo. (www.antiterroristas.cu)
